ACCEPTANCE OF THESE TERMS

By using our site, you confirm that you accept these Terms of Use and also agree to comply with them. If you do not agree to these Terms of Use, you must not use our site. You are also responsible for ensuring that all persons who access our site through their internet connection are aware of these terms of use and other applicable terms and conditions, and comply with them.

UPLOADING CONTENT TO OUR SITE

Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with our Acceptable Use Policy. You warrant that any such contribution complies with those standards, and you will be liable to us and indemnify us for any breach of that warranty.

LINKING TO OUR SITE

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You may use our site only for lawful purposes. You may not use our site:

These content standards apply to any and all material which you contribute to our site. GHS will determine, in its discretion, whether a contribution breaches the Content Standards.

A contribution must:

  • be accurate (where it states facts).
  • be genuinely held (where it states opinions).
  • comply with the law applicable in England and Wales and in any country from which it is posted.

A contribution must not:

  • be defamatory of any person.
  • be obscene, offensive, hateful or inflammatory.
  • promote sexually explicit material.
  • promote violence.
  • promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age.
  • infringe any copyright, database right or trade mark of any other person.
  • be likely to deceive any person.
  • breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  • promote any illegal activity.
  • be in contempt of court.
  • be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety.
  • be likely to harass, upset, embarrass, alarm or annoy any other person.
  • impersonate any person, or misrepresent your identity or affiliation with any person.
  • give the impression that the contribution emanates from GHS, if this is not the case.
  • advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse.
  • contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism.
  • contain any advertising or promote any services or web links to other sites.

BREACH OF THIS POLICY

When we consider that a breach of this Acceptable Use Policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this Acceptable Use Policy constitutes a material breach of the Terms upon which you are permitted to use our site, and may result in our taking all or any of the following actions:

  • immediate, temporary or permanent withdrawal of your right to use our site.
  • immediate, temporary or permanent removal of any Contribution uploaded by you to our site.
  • issue of a warning to you.
  • legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • further legal action against you.
  • disclosure of such information to law enforcement authorities as we reasonably feel is necessary or as required by law.

We exclude our liability for all action we may take in response to breaches of this Acceptable Use Policy. The actions we may take are not limited to those described above, and we may take any other action we reasonably deem appropriate.

GOVERNING LAW

This Acceptable Use Policy, its subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.

 

BOOKING SERVICE TERMS AND CONDITIONS

INTRODUCTION

These Booking Service Terms and Conditions, as may be amended from time to time, apply to our Booking Services. By accessing, browsing and using our Booking Platform and/or by completing a Booking, you acknowledge and agree to have read, understood and agreed to the Booking Service Terms and Conditions set out below (including our Privacy Policy).

1. DEFINITIONS

Accommodation Provider The provider of accommodation and other related products and services as from time to time made available for on the Booking Platform.
Booking The reservation or booking of products or services of an Accommodation Provider.
Booking Platform The area of the GHS Website on which the Booking Service is made available.
Booking Service The online booking request, reservation or booking service as offered or enabled by GHS in respect of various products and services as from time to time made available by Accommodation Providers on the Booking Platform. In respect of certain Accommodation Providers who are unable to make live rates and availability available on our Booking Platform, the Booking Service shall be limited to the transmission of the Booking Request submitted by a visitor to the Booking Platform to the relevant Accommodation Provider (as more fully set out in clause 2.3).

2. OUR BOOKING SERVICE

2.1 Relationship of the Parties: Through the Booking Platform GHS provides an online platform through which Accommodation Providers can advertise, market, sell, promote and/or offer (as applicable) their products and services for booking and through which visitors of the Booking Platform can search, compare, and make booking for such products and services. By making a Booking using the Booking Service provided by GHS, you enter into a direct and legally binding contractual relationship with the Accommodation Provider with which you have made your Booking and the Accommodation Provider is solely responsible for the provision of the products and services you have booked.

2.2 GHS’s Obligations (Live bookings only see clause 2.3 below for Booking Requests): From the point at which you make your Booking through the Booking Platform, GHS acts solely as an intermediary between you and the relevant Accommodation Provider, transmitting the relevant details of your Booking to the relevant Accommodation Provider to allow them to process and facilitate your Booking and sending you a Booking confirmation email for and on behalf of the Accommodation Provider. In the event that you wish to amend or cancel your Booking, and provided that you use the link in your Booking confirmation email to do so (so that the change is administered through the Booking Platform and not directly by the Accommodation Provider), GHS shall similarly, transmit the relevant details of the amendment of the cancellation to the Accommodation Provider to allow it to process and facilitate the amendment or cancellation and shall send you email confirmation of the amendment or cancellation. Please note that if you make an amendment or cancellation to your Booking through direct communication with the Accommodation Provider, GHS shall have no responsibility or liability to either you or the Accommodation Provider in respect of the amendment or cancellation.

2.3 Booking Requests: Certain Accommodation Providers are unable to make live rates and availability on the Booking Platform and in these cases, GHS provides a facility through which visitors to the Booking Platform can submit a booking request to the Accommodation Provider (a “Booking Request”). In respect of these Accommodation Providers only the Booking Service shall be limited to the display of the Accommodation Provider’s information on the Booking Platform and transmitting any Booking Request submitted by you through the Booking Platform to the relevant Accommodation Provider. The Accommodation Provider should respond to your Booking Request within 24 hours and will be responsible for issuing confirmation of any Booking materialising from the Booking Request. You should correspond directly with the Accommodation Provider in relation to all matters concerning the Booking. GHS shall have no further responsibility or liability in relation to any Booking that materialises from the Booking Request or in relation to any correspondence concerning the Booking. The Accommodation Provider should send a response to a Booking Request within 24 hours of the submission of the Booking Request through the Booking Platform, if you have not heard from the Accommodation Provider within this timeframe please follow up with the Accommodation Provider directly.

2.4 Information Displayed on our Booking Platform: The information made available on our Booking Platform reflects the information provided to us by Accommodation Providers. Our Accommodation Providers are given access to our extranet through which they are fully and solely responsible for updating all property and room descriptions and images, property and room amenities, room categories, maximum occupation limitations, rates/fees/ additional charges and taxes, availability, policies, terms and conditions and any other information which is displayed on our Booking Platform in respect of its services and products. Although we will use reasonable skill and care in performing our Booking Service, we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, and we shall have not responsibility or liability for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our Booking Platform or otherwise), inaccurate, misleading or untrue information or non-delivery of information.

2.5 Non- Commercial Use Only: Our Booking Service is made available for personal and non-commercial use only. You are strictly prohibited from re-selling, deep-linking, using, copying, monitoring, displaying, downloading or reproducing any content or information, software, Bookings, products or services available on our Booking Platform for any commercial or competitive activity or purpose.

2.6 No Endorsement: Our Booking Platform does not constitute, is not intended to serve as, and should not be regarded in any way as, a recommendation or endorsement of the quality, service level, qualification or rating of any Accommodation Provider or its products or services made available through our Booking Platform.

2.7 Free of Charge to Consumers: Our Booking Service is free of charge for consumers and we will not add any additional booking fees or charges to the rates offered by Accommodation Providers. You will pay the Accommodation Provider the relevant amount as indicated in the Booking confirmation email. Only the products and services of Accommodation Providers which have a commercial agreement with GHS will be made available on Booking Platform and the booking services we provide to our Accommodation Providers either form part of a wider range of services under the commercial agreement with our Accommodation Providers (for which they pay a fee) and/ or, in some cases, our Accommodation Providers may also pay us a commission (being a percentage of the value of a Booking) for Bookings made through our Booking Platform.

3. CREATING AN ACCOUNT

3.1 You may either access the Booking Platform and make a Booking as a ‘Guest’ or you may register for an account. To register for an account you must complete the registration process by following the instructions given on the GHS Website and you will receive your personal authentication credentials. It is your responsibility to keep your password secret, your account credentials are for your sole use and you shall be responsible for the activities carried out on the Booking Platform and any other part of the GHS Website from your account. All activities carried out through your account shall be attributed to you. You shall therefore be liable for any damage caused to GHS, Accommodation Providers or any other third parties as a result of the misuse, loss, misappropriation and/or compromise of the confidentiality of your account credentials. If you have any knowledge of any unauthorised used or your account credentials or any compromise to their confidentiality, you must notify GHS accordingly as soon as possible.

4. PRICES

4.1 Taxes, Fees and Additional Charges: All amounts payable for your Booking are clearly displayed on the Booking Platform including VAT (or other sales tax) and all other taxes (subject to the variation of such taxes), fees, and other charges unless stated otherwise on our Booking Platform and/or your Booking confirmation email. Applicable fees and taxes (including tourist/city tax) may be charged by the Accommodation Provider in the event of a no-show or cancellation.

4.2 Rate Restrictions: The Accommodation Providers may make available different rates on the Booking Platform for the same dates of stay. Some rates may carry special restrictions and conditions, for example they may be non-cancellable. You are strongly advised to thoroughly check the relevant terms and conditions that apply to a particular rate, and the product and service details prior to making any Booking.

4.3 Currency Converter: The currency converter provided on our Booking Platform and in your Booking confirmation email is for information purposes only and should not be relied upon as accurate or real time, actual rates may vary. The Accommodation Provider shall charge you the pound sterling amount shown in your Booking Confirmation for your stay, converted into the local currency of the Accommodation Provider using the prevailing exchange rate at the date of payment.

4.4 Errors and Mistakes: Obvious errors and mistakes (including misprints) are not binding on us or the Accommodation Providers.

5. PRIVACY AND COOKIES

5.1 GHS respects your privacy and is committed to protecting your personal data. Please see our Privacy Policy which sets out how we handle your personal data.

6. CREDIT CARD GUARANTEE

6.1 At the time of making a Booking on the Booking Platform you are required to provide credit card details solely for the purpose of guaranteeing your Booking. No payment is taken by GHS, you will be charged by the Accommodation Provider for your Booking in accordance with the payment terms stated at the time of Booking. Your card details are entered into a secure platform from which they are securely transmitted to the Accommodation Provider. No Booking can be treated as guaranteed until you have provided valid card details. When providing your credit card details you are advised to ensure that your card type is accepted by the Accommodation Provider (the cards accepted by each Accommodation Provider are stated on their listing on the Booking Platform) and that the card is valid up to and including your date of check-out. GHS shall have no responsibility or liability for ensuring that the credit card details provided by you are correct or valid, the verification of your card details shall be the responsibility of the Accommodation Provider.

7. PRE-PAYMENT, CANCELLATION, NO-SHOW AND GENERAL POLICIES OF ACCOMMODATION PROVIDERS

7.1 Acceptance by you of Cancellation, No-Show and other Policies of the Accommodation Provider: By making a Booking with an Accommodation Provider on our Booking Platform, you accept and agree to the relevant cancellation and no-show policies of that Accommodation Provider, and to any additional terms and conditions of the Accommodation Provider which apply to your Booking (this shall include any policies and/or terms and conditions of the Accommodation Provider displayed on our Booking Platform and the relevant house rules of the Accommodation Provider). Such terms shall also apply any additional services and/or products offered by the Accommodation Provider. The full terms and conditions of a particular Accommodation Provider can be obtained from the relevant Accommodation Provider using the contact details displayed for the Accommodation Provider on their listing on our Booking Platform. The general cancellation and no-show policy of each Accommodation Provider is made available on our Booking Platform on the Accommodation Provider’s listing, during the booking procedure and in the Booking confirmation email. Please note that certain rates, fees or special offers are not eligible for cancellation, refund or change. Applicable city/tourist tax may still be charged by the Accommodation Provider in the event of a no-show or charged cancellation. Please check the policies which apply to your product or service of choice thoroughly for any such conditions prior to making your Booking.

7.2 Managing your Booking: If you wish to review, amend or cancel your Booking, please refer to your Booking confirmation email and follow the relevant link (except for Bookings made via Booking Request). To review, amend or cancel a Booking materialising out of a Booking Request, please contact the Accommodation Provider directly. The Accommodation Provider shall be solely responsible for administering any such amendments or cancellations. Please note that you may be charged for cancelling a Booking in accordance with the Accommodation Provider's cancellation, (pre)payment and/or no-show policy or you may not be entitled to any repayment of any (pre)paid amount. We strongly advise that you read the cancellation, (pre)payment and no-show policy of the Accommodation Provider carefully prior to making your Booking and to make a note of and remember to make further payments on time as may be required for the relevant Booking.

7.3 Late or Delayed Arrival: In the event that you plan to arrive at your accommodation late or your arrival is delayed, please communicate this to the Accommodation Provider directly as soon as you are able so that they know when to expect to you and to avoid the possible cancellation of your Booking or the incurrence of cancellation or no-show fees. Please ensure that all such communication is made directly with the Accommodation Provider, GHS does not have any responsibility or liability for the consequences of your late or delayed arrival nor for any cancellation or no-showed fees imposed by the Accommodation Provider.

8. CORRESPONDENCE AND COMMUNICATION

8.1 Communications from GHS: By completing a Booking through our Booking Platform you agree to receive from GHS (i) a Booking confirmation email (ii) email confirmation of any amendments or cancellations you make to your Booking (iii) an email which we may send you shortly prior to your arrival date, giving you information on your destination and providing you with certain information and, if available, offers (including third party offers to the extent that you have actively opted in for this information) relevant to your Booking and destination, (iv) an email which we may send to you after your stay inviting you to complete our guest review form. See our Privacy Policy for more information about how we may contact you.

8.2 Communications from and with Accommodation Providers: GHS shall have no responsibility or liability for any communication from or with the Accommodation Provider. GHS shall securely transmit the details of your Booking, your payment details, your contact details, any amendments or cancellations to your Booking and any other relevant information provided by you to GHS and required by the Accommodation Provider in order to process and facilitate your Booking or Booking Request. GHS makes such information available to the Accommodation Provider on this basis and the Accommodation Providers have agreed only to use your personal data for the purposes for which it is transmitted to them. GHS shall not be liable for any misuse of your personal data by an Accommodation Provider and cannot guarantee that any request or communication will be duly and timely received and/or read by, complied with, executed or accepted by the Accommodation Provider.

8.3 Information Supplied by You: In order to duly complete and secure your Booking, you must use a correct and email address, accurate contact details and correct and valid details for your form of payment guarantee (credit card). GHS is not responsible or liable for, and shall have no obligation to verify, any wrong or misspelled email address or inaccurate or wrong (mobile) phone number or credit card details.

8.4 Complaints and Disputes: In the event that you are dissatisfied with our Booking Service or have any cause for complaint we ask that you address your concern or complaint to us before taking any other form of action so that we can have the best chance of resolving the issue reasonably, promptly and efficiently to the satisfaction of both parties. Any claim or complaint against GHS or in respect of the Booking Service should be promptly submitted to GHS, but in any event within 30 days after the scheduled day of consummation of the product or service (i.e. your check out date). As the Accommodation Providers on our Booking Platform constantly update and adjust their availability, we advise you to take a screenshot when making a Booking to support your position in the unlikely event of a dispute. Please note that GHS is only in a position to deal with issues or complaints in respect of the Booking Service it provides, if you have a complaint about the products and/or services provided by an Accommodation Provider, this should be addressed to the Accommodation Provider directly.

9. SEARCH RESULTS RANKING, PREFERRED PROGRAMME, STARS AND GUEST REVIEWS

9.1 Search Results Ranking: The order in which the properties on our Booking Platform appear in search results is determined by changing criteria which may include, but shall not be limited to; location, conversion rates, commissions, cancellation rates, price competiveness, inventory availability, customer feedback and strategic partnerships with certain Accommodation Providers.

9.2 Preferred Partners: In certain cities and regions, GHS operates a preferred partnership program, under the terms of which certain Accommodation Providers are listed ahead of the rest of the Accommodation Providers in the default ranking for the relevant city or region.

9.3 Star Ratings: The star rating displayed in respect of properties on the Booking Platform is not determined by GHS. The Accommodation Providers determine their star rating themselves or it is determined by an independent third party provider of objective star ratings (depending on local regulations). The star rating is provided to GHS by the Accommodation Provider. GHS does not impose formal requirements or obligations on star ratings and it does not review and verify them. Overall, the star rating is a representation of how the accommodation compares to the legal requirements (if applicable) or, if not regulated, the sector or industry standards in terms of price, facilities and available services (these requirements and standards vary between different countries and organisations).

9.4 Reviews: Only customers who have completed a stay booked through our Booking Platform will ever be invited by GHS to comment on their stay and to provide a score for various certain aspects of their stay or an overall score for the relevant property. GHS does not compensate or otherwise reward a customer for completing a review. Completed guest reviews submitted to GHS may be (a) uploaded onto the relevant Accommodation Provider's listing on our Booking Platform for the sole purpose of informing visitors to the Booking Platform of the reviewer’s opinion of the service level and quality of the accommodation provided by the Accommodation Provider, and (b) used by GHS at its sole discretion (e.g. for marketing, promotion, or improvement of our service) on our Booking Platform or such social media platforms, newsletters, special promotions, apps, or other channels owned, hosted, used, or controlled by GHS. In order to offer and maintain recent, relevant reviews, reviews can only be submitted within a limited period of time after a stay and each review will only be available for a limited period of time after submission. GHS reserves the right to adjust, refuse, or remove a reviews at our sole discretion if it violates our review policy. For example, GHS will not accept reviews which include:
(a) profanity, sexually explicit, hate speech, discriminatory, threats or violence;
(b) mention of full names;
(c) personal attack in respect of an individual(s);
(d) the promotion of illegal activities;
(e) website address and links, emails and addresses, phone numbers, payments details or any personal data; or
(f) politically sensitive comments

10. LIABILITY

10.1 Limitation of Liability: Subject to the provisions of this clause 9, GHS’ liability to you under these Booking Service Terms and Conditions and arising out of the provision of our Booking Service shall be limited to damages actually suffered, paid or incurred by you as a direct result of a breach by us of our obligations as set out in these Booking Service Terms and Conditions, up to a maximum amount of the total cost of your Booking as set out in the Booking confirmation email (whether for one event or series of connected events).

10.2 Excluded Liability: In no event shall GHS be liable to you for or in respect of (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the Accommodation Provider as made available on our Booking Platform, (iii) the services performed or the products offered by the Accommodation Provider or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our Booking Platform, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the Accommodation Provider or any of our other business partners (including any of their employees, directors, officers, agents, representatives, subcontractors or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the Booking Platform, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

10.3 No Representation or Warranty: GHS is not responsible for and shall have no liability in respect of the use, validity, quality, suitability, fitness and due disclosure of the accommodation or other products and services booked through our Booking Platform and makes no representations, warranties or conditions of any kind in this respect, whether implied, statutory or otherwise, including any implied warranties of merchantability, title, non-infringement or fitness for a particular purpose. You acknowledge and agree that the relevant Accommodation Provider is solely responsible and assumes all responsibility and liability in respect of your Booking (including any warranties and representations made by the Accommodation Provider). All complaints or claims in respect of your Booking (including those related to the offered price, policies or any specific requests made by you are to be dealt with by the Accommodation Provider. GHS is not responsible for and shall not have any liability for any such complaints.

10.4 No Exclusion: Notwithstanding the above, nothing in these Booking Services Terms and Conditions shall exclude our liability for (i) death or personal injury caused by our negligence, (ii) fraud or fraudulent misrepresentation; (iii) a breach of the terms implied by Section 2 of the Supply of Goods and Services Act 1982 (Title and possession) or (iv) any other liability which cannot be excluded by law.

10.5 Tax Compliance: You agree and acknowledge that the Accommodation Provider is at all times responsible for the collection, withholding, remittance and payment of the applicable taxes due on the total amount of the Booking price or fee to the relevant tax authorities. GHS is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the Booking price or fee to the relevant tax authorities. GHS does not act as the merchant of record for any product or service made available on the Booking Platform.

11. INTELLECTUAL PROPERTY

11.1 Unless stated otherwise, the software required for our Booking Services or available at or used by our Booking Platform and the intellectual property rights, including copyright, in the contents and information of and material on our Booking Platform are owned by GHS or its Accommodation Providers or providers.

12. GOVERNING LAW AND JURISDICTION

12.1 Governing Law and Jurisdiction: These Booking Service Terms and Conditions and the provision of our Booking Services are governed by and construed in accordance with English law. Any dispute arising out of these Booking Service Terms and Conditions and our Booking Services shall exclusively be submitted to the courts of England and Wales.

12.2 Severability: If any provision of these Booking Service Terms and Conditions is or becomes invalid, unenforceable or non-binding, you shall remain bound by all other provisions hereof. Any invalid provision of these Booking Service Terms and Conditions shall nonetheless be enforced to the fullest extent permitted by applicable law, and you agree to accept a similar effect as the invalid, unenforceable or non-binding provision, having regard to the content and purpose of these Booking Service Terms and Conditions.
